Apple Faces Class Action Lawsuit from YouTube Creators: Millions of Videos Illegally Scraped to Train AI Models

Famous YouTube channels h3h3Productions, MrShortGame Golf, and Golfholics, along with several other creators, this week officially filed a class action lawsuit against Apple, accusing the tech giant of violating the Digital Millennium Copyright Act (DMCA) by illegally scraping millions of YouTube videos to train its AI models. This move not only lands Apple in a new legal storm but also highlights the increasingly tense relationship between content creators and big tech companies in the era of generative AI.

Apple Faces Class Action Lawsuit from YouTube Creators Over Unauthorized Video Scraping for AI Training

This lawsuit filed in federal court in California features plaintiffs who are content creators from various fields. Leading them is the husband-and-wife creator duo Ethan Klein and Hila Klein, who founded h3h3ProductionsThe channel is known for its humorous commentary and satirical content, with millions of subscribers on YouTube. They later founded the H3 Podcast and H3 Podcast Highlights channels, which have also amassed large followings on the platform.

The other two plaintiffs are creators in the golf space:MrShortGame Golf and GolfholicsBoth channels have hundreds of thousands of subscribers, focusing on golf instruction and competition content. This combination shows that both entertainment and educational creators are angry about tech giants using their content without authorization.

According to court documents, the plaintiffs allege that Apple “willfully circumvented” YouTube’s anti-scraping protections and “profited substantially” from doing so. The complaint states: “This is not merely illegal activity, but a shameless attack on the content creator community: their work was used to fuel a generative AI industry worth trillions of dollars, yet they received no compensation.”

Panda-70M Dataset: The Core of the Litigation

The technical core of this case revolves around a Panda-70M the dataset. According to the plaintiff’s allegations, this dataset does not directly store video content but rather indexes YouTube videos in a highly granular manner: each record contains a URL, video identifier, and timestamp. The plaintiff described this as “a detailed map” that guides the system to precisely locate and extract specific segments.

Litigation documents indicate that Apple researchers published an academic paper in late 2024 titledSTIV: Scalable Text and Image Conditioned Video Generationclearly disclosed that video generation models were trained using the Panda-70M dataset. The plaintiffs claim that their content appeared in that dataset more than 500 times.

The key legal issue is that each time a clip is extracted from YouTube, it requires independently bypassing the platform’s technical protection measures. The plaintiff argues that this constitutes repeated DMCA violations. Under U.S. law, each intentional circumvention of technical protection measures may result in maximum statutory damages.

Chain Lawsuits: More Than Just Apple

Notably, these plaintiffs have recently launched similar attacks against multiple tech giants. In addition to Apple, they have also Meta、Nvidia、ByteDance、Snap、Amazon and OpenAI Filed a lawsuit accusing these companies of similarly using the Panda-70M dataset to train their respective AI models.

This “class action” strategy demonstrates that YouTube creators are attempting to collectively defend their rights through legal channels, challenging the AI industry’s long-standing content usage practices. For content creators, this is not merely a question of compensation, but a fundamental issue of how to protect the value of their work in the AI era.

Creators’ Fury: Our Work Is Being Used ‘For Free’ to Train AI

This lawsuit highlights the growing dissatisfaction among content creators toward big tech companies. Many YouTubers point out that they invest significant time and resources creating content, only to discover their work has been used to train AI systems that may ultimately replace them, all without compensation or even informed consent.

h3h3Productions’ Ethan Klein and Hila Klein hold considerable influence within the YouTube community, and their involvement has brought greater attention to the lawsuit. Known for their outspoken style over the years, this couple’s lawsuit against Apple is being viewed as a significant battle between influencers and tech giants.

The plaintiff seeks various remedies in the lawsuit, including:

  • Confirm this as a class action, allowing all affected creators to participate.
  • Found Apple to have violated DMCA provisions
  • Statutory damages for each violation (the maximum amount prescribed by law)
  • Preliminary and Permanent Injunctions, Prohibiting Apple from Continuing to Use the Related Content
  • Legal fees and litigation costs

If the court approves the injunction, it will prohibit Apple and its partners, contractors, licensees, and all other entities that actively participate or cooperate from continuing to use this content.
