The same applies to those who commit adultery.” The restrictions on sexual autonomy guaranteed by Article 22 of the Constitution are inconsistent with the principle of proportionality in Article 23 of the Constitution, and shall lose their effectiveness from the date of promulgation of this interpretation; within this scope, the Interpretation No. 554 of this Court shall be changed.

The proviso to Article 239 of the Criminal Procedure Law stipulates: “However, the crime of Article 239 of the Criminal Law shall not be as effective as that of an adulterer if the spouse withdraws the complaint.” It is contrary to the intention of Article 7 of the Constitution to protect the right to equality, and because Article 239 of the Criminal Law has been declared unconstitutional and invalidated by this interpretation, it shall also lose its validity from the date of the promulgation of this interpretation.
