Netflix, a popular streaming video service provider all over the world, has been raising monthly fees and restricting family sharing user rights in recent years. Even if consumers are dissatisfied, they can only pay the price. However, it has recently been hit hard in Italy. The Court of Rome, Italy, recently ruled that some of Netflix Italia’s terms that allowed the platform to unilaterally adjust subscription prices and contract conditions from 2017 to January 2024 were “unfair” and therefore invalid. This also means that price increases incurred over the years due to these terms may have to be refunded to local users.
Rome court finds some price adjustment clauses invalid
The case was initiated by Rome-based consumer rights group Movimento Consumatori, which pointed out that the court had found that some price adjustments implemented by Netflix in 2017, 2019, 2021, and November 2024 were illegal, but that new contracts signed after January 2024 were not within the scope of this ruling. According to the statement, affected subscribers can not only claim for the return of past overpayments, but also have the right to demand that the current plan price return to a lower level, and even further claim for damages.
Premium can refund up to approximately NT$17,500
At present, what the outside world is most concerned about is still how much money users may get back. Movimento Consumatori quoted an attorney as saying that if you are a Premium user who has continued to subscribe since 2017, the cumulative amount you can request for refund is about 500 euros; the Standard plan is about 250 euros. Based on a rough estimate of NT$35 for 1 euro, the potential refund for Premium users is about NT$17,500, and for Standard users it is about NT$8,750. The Taiwan dollar figure here is a conversion estimate, and the actual amount still needs to be calculated based on the final exchange rate and individual subscription period.
Not only will there be a refund, the current monthly fee may also be forced to be revised downwards.
The Italian consumer group further pointed out that based on the standards determined by the court, if the current monthly fee of the Premium plan is 19.99 euros, it can theoretically return to 11.99 euros; if the Standard plan is currently 13.99 euros, it may return to 9.99 euros. This means that the question is no longer just “whether to refund the money”, but whether Netflix’s current price structure in Italy must also be adjusted accordingly. For a streaming platform that relies heavily on global subscription revenue growth, this will be a more sensitive operating signal than a single refund.
Consumer groups say millions of users involved, Netflix will appeal
Judging from public statements by consumer groups, the impact of this incident may be quite large. Movimento Consumatori stated that Netflix’s user base in Italy has grown from approximately 1.9 million households in 2019 to approximately 5.4 million households in October 2025. The court’s determination this time involves the rights and interests of “millions of consumers.” The group also mentioned that more than 25,000 consumers have expressed dissatisfaction and concerns to them in the short time since the latest statement was released. If Netflix does not proactively issue refunds and adjust prices, the group will further push for a class action lawsuit.
Netflix did not accept the results.According to reports, a Netflix spokesperson has stated that the company will appeal, and emphasized that Netflix has always “taken consumer rights very seriously” and believes that its terms have always complied with Italian law and market practices. In other words, this controversy may not end anytime soon. For Netflix, this is not just a legal attack and defense in the Italian single market, but may also affect whether similar tests will occur in other European markets: when digital subscription services have long relied on the “platform can adjust its own price” clause, whether local laws will be on the side of consumers (according to the Taiwanese market).
